This article from Epoch Times quotes the Leftist ACLU slandering the Alien Enemies Act of 1798 as if illegal alien is not the issue, claiming it is again immigrants. No one in the US is against immigrants. We are opposed to violations of the rule of law, to invasion, to illegal aliens, to illegal immigrants. Further, the ACLU said the act could be used “to deport millions” of people without judicial review.

Implied is denying there are co-equal branches of government, that everything the Executive branch does should be subject to the whims and review of the Judiciary. This is an overly legalistic world view. See the 11th Amendment on the limits of the judiciary to jurisdiction. War is not under the jurisdiction of the Judicial branch of government.

The Judiciary are unelected bureaucrats. It is the Chief Executive who is elected by the people and the people have spoken. They want an end to the war, to the invasion at the southern border.

Another ploy the Left is using is to treat as sacrosanct the "independence" of the Department of Justice. Worse than an overly legalistic world view, this is Deep State propaganda, THE threat to democracy.

The last thing a republic needs are independent departments of government. Otherwise, we'd succumb to the Administrative State. No government department should have any independence whatsoever! All government agencies must be held accountable to the people through their elected representatives, starting with POTUS on day to day matters and ending with Congress in the event of high crimes and misdemeanors after appearing before regular oversight committees.

The act is big subject to judicial review as national security matters are the purview of the executive branch.
